Online Interior Design Services Terms and Conditions


Sence Interiors, LLC (“Designer”) is providing Online Design Services to you (“Client”). These terms and conditions are a binding contract between you, the Client, and the Designer. In purchasing any of the Online Interior Design Packages (collectively, the “Services”), YOU AGREE THAT YOU HAVE READ, UNDERSTOOD, AND WILL BE BOUND BY THE BELOW.

  1. Client must purchase an Online Interior Design Package on Designer’s website. All fees are in US Dollars and are due at the time of purchase. Payments must be made via Stripe or ACH Transfer.

  2. Client represents that Client is at least 18 years of age.

  3. Following purchase of an Online Interior Design Package, Client will provide all information requested by Designer concerning the Project (including, without limitation, completed questionnaire, budget information, space measurements, existing furniture images and measurements, etc.) to Designer through the design platform or via email. Client agrees to participate in an initial Project video call with Designer, if requested by Designer. Client is solely responsible for the accuracy, reliability and completeness of all measurements and other information provided to Designer.

  4. After Designer has received the information from Client in accordance with paragraph 3, no full or partial refunds will be given in case of cancellation by Client.

  5. Consistent with the Online Interior Design Package purchased and the information provided by Client, Designer will recommend concepts, color schemes, and products to Client that may include furnishing, accessories, paint colors, wall coverings, etc. This information will be provided to Client in the form of a Quote (“Shopping List”). Client will be able to approve or decline each item listed on the Shopping List. With the approval of each item, Client agrees to pay the retail price for each item, including shipping and delivery costs once they receive the Invoice. All declined items will be replaced by Designer with a second option. If there is a change to availability after the Client receives the Invoice for approved items, the Designer is not obligated to select replacement items.  Client acknowledges and agrees that products included on the Shopping List are not products supplied or sold by Designer, and Designer bears no responsibility for the availability for purchase of any items on the Shopping List.

  6. Designer will prepare and provide to Client a Floor Plan, a Design Board, 2 Revisions if needed (valid within 30 days of the Initial Design Board submission), a Shopping List, and Invoice. The Design Board will include products from the Shopping List.

  7. After receipt of the Initial Design Board, Client has 30 days to provide feedback to Designer via the online platform for up to 2 Design Revisions.  Client agrees to participate in a video call with Designer to discuss Client’s feedback if requested by Designer. Designer will incorporate Client’s feedback and provide an updated Design Board (the “Design Board Revisions”) and updated Shopping List, considering Client’s reasonable feedback, within 30 days of the submission of the Initial Design Board.

  8. Following receipt of the Floor Plan, Final Design Board, Shopping List, and Invoice, the Services covered by this agreement are complete, and no refunds or returns will be acknowledged. For any additional services, Client must purchase another Online Interior Design Package, or Client agrees to pay the Designer’s hourly rate.

  9. Client agrees not to copy, reproduce, distribute, publish, display, or broadcast any deliverables of Designer, or any other part of the Service, without the express written consent of Designer.

  10. Client acknowledges and agrees that Designer maintains ownership and all rights to any Design Board and Design Revisions, and Designer may copy, reproduce, distribute, publish, display, or broadcast the Final Design Board at Designer’s discretion. Any Client who opts to send “before and after” photographs, renderings, drawings or images (“Client-Provided Images”) of the Project to Designer agrees that Designer may use such Client-Provided Images in connection with any marketing, promotional and/or advertising material of the Designer.  Client consents to Designer’s use of Client-Provided Images in Designer’s marketing materials, including, without limitation, publication on Designer’s website, social media accounts and other electronic and printed media, or in any other media, and Client hereby grants to Designer an irrevocable, worldwide, royalty free license to use Client-Provided Images for any marketing, promotion or design purposes. Designer will not publicly disclose the Client’s name or other personally identifiable information without Client’s consent.

  11. The Online Interior Design Services are subject to the following limitations:

    1. THE FLOOR PLAN, DESIGN BOARD, DESIGN BOARD REVISIONS, AND SHOPPING LIST, ARE PROVIDED ON AN “AS IS, WHERE IS” BASIS WITHOUT EXPRESSED OR IMPLIED WARRANTY OF ANY KIND.  DESIGNER DISCLAIMS ANY AND ALL WARRANTIES REGARDING THE SERVICES, INCLUDING THE FLOOR PLAN, DESIGN BOARD, SHOPPING LIST, OR DESIGN REVISIONS, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.  DESIGNER MAKES NO REPRESENTATIONS OR WARRANTIES CONCERNING THE SERVICES OR ANY OTHER INFORMATION PROVIDED BY DESIGNER TO CLIENT HEREUNDER.  BY PURCHASING ANY SERVICES HEREUNDER, CLIENT EXPRESSLY ACKNOWLEDGES AND AGREES THAT CLIENT HAS READ AND UNDERSTOOD THE AFOREMENTIONED WAIVERS AND DISCLAIMERS.

    2. The Shopping List and Invoices will include retail pricing and shipping and delivery costs from each third-party vendor.  Designer makes no representations or warranties with respect to any products or shipping costs included on the Shopping List, or any third-party vendor included therein. The Designer cannot guarantee availability or price for items on the Shopping List.

    3. The Floor Plan, Design Board, Design Revisions, Shopping List, and any other information provided by Designer to Client in the performance of the Services are not intended to be used for construction purposes.

    4. The Designer will not arrange purchase, delivery, installation, or any other work or other services necessary to execute the Shopping List, Design Board, Design Revisions, or any other Services.

    5. The Online Design Services do not include the design of any electrical, plumbing, heating, or other mechanical systems.

    6. The Online Design Services do not include instruction on any structural changes that might be needed to execute the Project.

    7. The Designer will not engage with any hired laborers, contractors, carpenters, plumbers, landscapers, electricians, installers, or other tradespeople on behalf of Client.

    8. Designer bears no liability relating to or arising out of its performance of the Services (including Designer’s performance thereof), the Floor Plan, Shopping List, Design Board, or Design Revision.  Client hereby waives any and all claims against Designer relating to or arising out of the Services (including the performance thereof), the Floor Plan, Shopping List, Design Board, or Design Revisions regardless of the legal theory giving rise to any Client claim, and whether such liability arises in contract (including breach, indemnity or warranty), tort (including fault, negligence or strict liability), or otherwise.

  12. This contract is subject to, and shall be construed in accordance with, the laws of the State of Arizona.
